ANNEX XV

INSTRUCTIONS CONCERNING THE FISHING LOGBOOK, LANDING DECLARATION AND TRANSHIPMENT DECLARATION

The following minimum information on the vessel’s fishing activities is the one to be recorded in the fishing logbook and/or other catch documentation, as applicable, in accordance with Articles 14, 17, 19a, 21, and 23 of Regulation (EC) No 1224/2009 and Title VI, Chapter II of this Regulation. This is without prejudice to any additional requirements set under the rules of the CFP or by the national authorities of a Member State or a third country, including the possibility for the competent authorities of the flag Member State, where appropriate, to supplement the available data prior to its exchange.

ICES statistical rectangles provide a grid covering the area between 36° N and 85° 30′ N and 44° W and 68° 30′ E. Latitudinal rows, with intervals of 30′, are numbered (two-digits) from 01 to 99. Longitudinal columns, with intervals of 1°, are coded according to an alphanumeric system, beginning with A0 using a different letter for each 10° block, to M8, except I.

The number of a rectangle in the GFCM statistical grid is a 5 digits code: (i) Latitude is covered by a composed 3 digits code (one letter and two numbers). Maximum range from M00 (30° N) up to M34 (47° 30′ N), (ii) Longitude is covered by a composed code of a letter and a number. The letter range is from A to J and number range per letter is from 0 to 9. Maximum range from A0 (6° W) up to J5 (42° E).

In Baltic Sea (only for salmon) and in GFCM area (only for tunas, swordfish, and highly migratory sharks) and, if applicable, in other areas, number of fish caught per fishing operation shall be also recorded.

Exemptions to landing obligation: as referred to in Article 15(4) and Article 15(5) of Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on the Common Fisheries Policy and as amended by Regulation (EU) 2015/812 of the European Parliament and of the Council of 20 May 2015, in particular:

species in respect of which fishing is prohibited and which are identified as such in a Union legal act adopted in the area of the common fisheries policy,

species for which scientific evidence demonstrates high survival rates, taking into account the characteristics of the gear, of the fishing practices and of the ecosystem,

catches falling under de minimis exemptions,

fish which shows damage caused by predators.

Trans-zonal activity means that the vessel remains within an zone not exceeding 5 nautical miles on either side of the line separating two effort zones.

The departure shall be recorded in the fishing logbook before the catching vessel leaves the port or a landing site.

The return shall be recorded in the fishing logbook immediately before the catching vessel enters port or arrives at the landing site.

The date and time (including at least hours and minutes) shall be recorded in UTC.

The port or landing site shall be recorded using the codes published in the Master Data Register page of the European Commission Fisheries website.

Gear information shall be provided at departure and return to port, as well as for any activity where fishing gear is deployed.

Where the master of the vessel is reporting catches and discards per fishing operation (haul by haul), the information on the fishing gear shall be reported per fishing operation (haul). Where the master of the vessel is reporting aggregated catches covering multiple fishing operations (hauls), the information on the fishing gear shall be reported for the aggregated period.

(11) Gear type

MThe type of gear shall be indicated using the codes in the code list GEAR_TYPE as defined on the Master Data Register on the website of the European Commission.

(12) Mesh size

(14) Gear dimension

Gear dimensions and technical specification, such as the size and the number shall be given according to the specifications set out in column 2 of Annex XVI of this Regulation.

Where gear attachments, FADs, Acoustic Deterrent Devices (ADDs), as defined in Article 6(44) of Regulation (EU) 2019/1241, or other devices, including devices allowing the use of derogations, for example, from the landing obligation, are used, they shall also be reported.

Gear devices codes available on the Master Data Register page of the European Commission Fisheries website shall be used.

(15) Number of fishing operations

Number of fishing operations.

Where the master of the vessel is reporting catches and discards per fishing operation (haul by haul), the number of fishing operations will be 1. Where the master of the vessel is reporting aggregated catches covering multiple fishing operations (hauls), the number of fishing operations shall be the number of individual operations (hauls) carried out during the aggregated period.

(16) Depth

CIF fishing depth is regulated in the area where the operation takes placeFishing depth shall be recorded as average depth and in metres.

(17) Information about gear lost at sea

CIF fishing gear lost at sea

The date and estimated time (including at least hours and minutes) shall be recorded in UTC.

The geographical position shall be recorded using coordinates of latitude and longitude on the World Geodetic System 1984 with an accuracy of 4 decimal places, and a position error of less than 50 metres.

The following information shall also be recorded:

the type and approximate dimensions of the lost gear;

the measures undertaken to retrieve the lost gear.

Information about the activityThe master(s) of all catching vessel(s) participating to a pair fishing operation shall keep a fishing logbook indicating the quantities caught and kept on board in such a way that there is no double counting of catches.

(18) Date and time of the activity

M

The date and time of the activity shall be recorded in the logbook after completion of the activity. The date and time (including at least hours and minutes) shall be recorded in UTC.

Where the master of the vessel is reporting catches and discards per fishing operation (haul by haul), the date and time of the end of each operation shall be recorded.

The end of the operation is when the gear is fully retrieved and onboard.

When reporting transhipments, the date and time of the end of the activity shall be recorded.

When reporting landings, the date and time of the start (where the activity takes more than 24 hours) and the end of the activity shall be recorded.

(19) Fishing time

OTotal time spent for all activities in connection with fishing operations (searching for fish, the shooting, towing and hauling of active gears, setting, soaking, removing or resetting of passive gears and the removal of any catch from the gear, keep nets, or from a transport cage to fattening and farming cages) shall be given in minutes and equals the number of hours spent at sea minus the time spent in transit to, between and returning from the fishing grounds, dodging, inactive or waiting for repair.

(20) Position of the activity

CIF vessel with LOA of >=12mThe geographical position of each activity using coordinates of latitude and longitude on the World Geodetic System 1984 with an accuracy of 4 decimal places, and a position error of less than 50 metres.

(21) Geographical area of capture

M

The relevant geographical area(s) of capture shall be reported for every fishing activity in which catches are reported.

For catches reported in transhipment and landing reports, the geographical area shall be reported in the same way as for fishing operations.

The relevant geographical area means the area in which the majority of the catch was taken during a fishing operation and it shall be reported at the most detailed level available. Where the master is not able to determine where the majority of the catch was taken during one operation, the area where the majority of that fishing operation (time) took place shall be the relevant geographical area.

(22) Catches caught and kept onboard

Estimated live weight equivalent in kilograms and/or, where appropriate, the number of individuals;

Size class: Legally sized (LSC) or below minimum conservation reference size (BMS).

The quantities shall include quantities set aside for consumption by the crew of the vessel.

Where catches are held in baskets, boxes, bins, cartons, sacks, bags, blocks or other containers, the net weight of the unit used shall also be recorded in kilograms live weight, and the precise number of such units.

Where catches have been weighed using systems approved by the competent authorities of the Member States, the result of the weighing, expressed in kilograms live weight for each species, shall be recorded as the estimated quantity. It shall be indicated whether catches have been weighed on board for the purposes of Article 60(3)(b) of Regulation (EC) No 1224/2009.

The species codes available on the Master Data Register page of the European Commission Fisheries website shall be used.

(23) Estimated discards

M

At least the following information about the catches discarded shall be reported:

FAO alpha-3 code of the species. The code MZZ shall be used to report nil-catches;

Estimated live weight equivalent in kilograms and/or, where appropriate, the number of individuals.

Discards of quantities of each species, whether or not these benefit from exemptions to the landing obligation, shall be recorded separately using the code DISCARDED. This includes discards of species taken for live bait purposes and which are recorded in the logbook.

Discards of quantities of each species to which specifically de minimis exemptions apply, shall be recorded separately using the code DEMINIMIS.

The reason for the discards shall also be recorded using the codes on the Commission’s Master Data Register page.

(24) Catches, incidental by-catches and release of other marine organisms or animals

CIF in the GFCM area

The following information shall as well be recorded separately:

Daily catches of red coral (including area and depth),

Incidental by-catch and release of seabirds,

Incidental by-catch and release of seals,

Incidental by-catch and release of sea turtles,

Incidental by-catch and release of cetaceans.

FAO alpha-3 code of the species shall be used.

The weights shall be recorded in kilograms live weight equivalent.

The master shall ensure that the weights recorded separately are reported in such a way that there is no double counting.

Incidental by-catches of marine animals shall be recorded using the code BY_CATCH.

Where applicable, marine animals released to sea shall be recorded using the general code RELEASED.

The species codes available on the Master Data Register page of the European Commission Fisheries website shall be used.

(25) Incidental catches of sensitive species

CIF incidental catches of sensitive species

The discards of sensitive species shall be reported including at least the following information:

FAO alpha-3 code of the species;

The quantities in kilograms live weight and/or, where appropriate, the number of individuals.

The discards shall be reported separately for catches injured, dead and released alive.

The reason for the discards shall also be recorded using the codes on the Commission’s Master Data Register page.

The species codes available on the Master Data Register page of the European Commission Fisheries website shall be used.

(26) Catches transhipped and onboard after transhipment

CIF transhipment

At least the following information about the fishery products transhipped and the catches onboard after transhipment shall be reported:

FAO alpha-3 code of the species;

Estimated Product weight in kilograms;

Estimated Live weight equivalent in kilograms and/or, where appropriate, the number of individuals;

Conversion factor used to calculate the equivalent live weight in accordance with Article 28 of this Regulation for fishery products;

Presentation of the fish using the codes in table 1 of Annex I;

Processing state using the codes in table 2 of Annex I;

Size class: Legally sized (LSC) or below minimum conservation reference size (BMS);

The geographical area where the catches have been taken.

When fishery products have been transhipped, and if they have been weighed using systems approved by the competent authorities of Member States, on either the catching vessel, donor or receiving fishing vessel, then the outcome of the weighing of quantities of each species in kilograms live weight shall be recorded as the estimated quantity.

In other cases, the estimated product weight (in kilograms), shall be provided.

Where catches or fishery products are held in baskets, boxes, bins, cartons, sacks, bags, blocks or other containers, the net weight of the unit used shall also be recorded in kilograms product weight, and the precise number of such units.

Where catches are transhipped by fishing vessels, other than catching vessels, the unique fishing trip ID related to the catches shall also be recorded.

(27) Catches landed

CIF landing

At least the following information about the fishery products landed shall be reported:

FAO alpha-3 code of the species;

Product weight in kilograms for fishery products;

Live weight equivalent in kilograms and/or, where appropriate, the number of individuals;

Conversion factor used to calculate the equivalent live weight in accordance with Article 28 of this Regulation for fishery products;

Presentation of the fish using the codes in table 1 of Annex I for fishery products;

Processing state using the codes in table 2 of Annex I for fishery products;

Size class: Legally sized (LSC) or below minimum conservation reference size (BMS);

The unique fishing trip ID related to the catches;

The geographical area where the catches have been taken.

Without prejudice to the results of an inspection, when fishery products have been weighed using systems approved by the competent authorities of Member States, on either the catching vessel, donor or receiving fishing vessel, then the actual weight of quantities landed shall be indicated in kilograms product weight and their equivalent live weight.

Where fishery products are held in baskets, boxes, bins, cartons, sacks, bags, blocks or other containers, the net weight of the unit used shall also be recorded in kilograms product weight, and the precise number of such units.

The species codes available on the Master Data Register page of the European Commission Fisheries website shall be used.

(28) Catches and fishery products retained onboard at departure

CIF

Where catches from a previous trip are kept onboard at departure from a port or a landing site, at least the following information about the catches and fishery products shall be reported:

FAO alpha-3 code of the species;

Estimated product weight in kilograms for fishery products;

Estimated live weight equivalent in kilograms and/or, where appropriate, the number of individuals;

Conversion factor used to calculate the equivalent live weight in accordance with Article 28 of this Regulation for fishery products;

Presentation of the fish using the codes in table 1 of Annex I for fishery products;

Processing state using the codes in table 2 of Annex I for fishery products;

Size class: Legally sized (LSC) or below minimum conservation reference size (BMS);

The unique fishing trip ID related to the catches;

This is without prejudice to any additional requirements set under the rules of the CFP or by the national authorities of a Member State or a third country, including the possibility for the competent authorities of the flag Member State, where appropriate, to supplement the available data prior to its exchange.

In Baltic Sea (only for salmon) and in GFCM area (only for tunas, swordfish, and highly migratory sharks) and, if applicable, in other areas, number of fish caught per fishing operation shall be also recorded.

(7) Buyer’s identification

MThe date when the sales takes place. It shall be recorded in UTC.

(12) Time

OThe time (including at least hours and minutes) when the sales takes place. It shall be recorded in UTC.

(13) Sales batch

OReference to the relevant fish product.

(14) Invoice reference

OA reference number to the invoice or the sales’ contract, as defined by the Member State in which the transaction takes place.

(15) Take-over declaration reference

CIFReference to the relevant take-over declaration.

(16) Product identification

For all products subject to common marketing standards, at least the following information shall be reported:

FAO alpha-3 code of the species;

Product weight in kilograms, broken down by type of product presentation and state of processing and, where appropriate, the number of individuals;

Usage/destination for the fish. It shall be recorded using the codes published in the Master Data Register page of the European Commission Fisheries website. For BMS species, the destination cannot be for direct human consumption.

Presentation of the fish using the codes in table 1 of Annex I for fishery products;

Processing state using the codes in table 2 of Annex I for fishery products;

Size class: Legally sized (LSC) or below minimum conservation reference size (BMS).

For fishery products below the minimum conservation reference size, the quantities in kilograms expressed in net weight, or, where appropriate, the number of individuals.

Where fishery products are held in baskets, boxes, bins, cartons, sacks, bags, blocks or other containers, the net weight of the unit used shall also be recorded in kilograms product weight, and the precise number of such units.

Vessel transport means

(17) CFR number or Internal registration number (IR)

CIFCFR identification of the fishing vessel, when required by Implementing Regulation (EU) 2017/218. For any other vessels, a unique internal national registration number must be provided instead.

(18) Name of the vessel

CIFThe name of the vessel, where available.

(19) External Identification

MPort letters and number(s), in accordance with Article 7(1)(a) of this Regulation.

(20) Vessel country

MFlag State of the fishing vessel.

(21) Contact party

OName and detailed address (street name, number, city, postal code, Member State or third country) of the master of the vessel.Fishing activity

(22) Unique fishing trip identification number (Trip ID)

MThe EU fishing trip ID corresponding to the relevant fish products. Where a specific trip ID of a third country or RFMO is required, such trip ID(s) will also be provided.

(23) Geographical area of capture

Location where the majority of the catch was taken during a fishing operation as referred to in annex XV(21) of this Regulation.

The catch area shall be detailed at least to the level required by the traceability rules in Article 58(5)(e) of Regulation (EC) No 1224/2009. Where sales notes are used for catch reporting under Article 33(1) and (3) of Regulation (EC) No 1224/2009, the catch area must meet the minimum detail necessary for monitoring quota uptake and fishing effort.

Area codes available on the Master Data Register page of the European Commission Fisheries website shall be used.

Landing

(24) Location

MThe port or landing site shall be recorded using the codes published in the Master Data Register page of the European Commission Fisheries website.

(25) Date of the landing

MThe date of the start and the end of the activity shall be recorded where the activity took more than 24 hours. It shall be recorded in UTC.

(26) Time of the landing

OThe time (including at least hours and minutes) of the start and the end of the activity shall be recorded where the activity took more than 24 hours. It shall be recorded in UTC.
