Council Regulation (EU) 2019/124 of 30 January 2019 fixing for 2019 the fishing opportunities for certain fish stocks and groups of fish stocks, applicable in Union waters and, for Union fishing vessels, in certain non-Union waters

Article 10, Article 12(2), Articles 14, 20, 21, 26, 32, 33, 34, 39, 42, 43 and 50 shall continue to apply, mutatis mutandis, in 2020 until the entry into force of the Regulation fixing the fishing opportunities for 2020.

Article 53

Entry into force

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2019.

However, Article 9 shall apply from 1 February 2019. The provisions on fishing opportunities set out in Articles 21, 22 and 23 and Annexes IE and V for certain stocks in the CCAMLR Convention Area shall apply from 1 December 2018.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

The tables in Annexes IA, IB, IC, ID, IE, IF, IG, IJ, IK and IL set out the TACs and quotas (in tonnes live weight, except where otherwise specified) by stock, and the conditions functionally linked thereto, where appropriate.

All fishing opportunities set out in this Annex shall be subject to the rules set out in Regulation (EC) No 1224/2009, and in particular Articles 33 and 34 of that Regulation.

The references to fishing zones are references to ICES zones, unless otherwise specified. Within each area, fish stocks are referred to following the alphabetical order of the Latin names of the species. Only Latin names identify species for regulatory purposes; vernacular names are provided for ease of reference.

Picked dogfish shall not be targeted in the areas covered by this TAC. When accidentally caught in fisheries where picked dogfish is not subject to the landing obligation, specimens shall not be harmed and shall be released immediately, as required by Articles 14 and 50 of this Regulation. By way of derogation from Article 14, a vessel engaged in the by-catch avoidance programme that has been positively assessed by the STECF may land not more than 2 tonnes per month of picked dogfish that is dead at the moment when the fishing gear is hauled on board. Member States participating in the by-catch avoidance programme shall ensure that the total annual landings of picked dogfish on the basis of this derogation do not exceed the above amounts. They shall communicate the list of participating vessels to the Commission before allowing any landings. Member States shall exchange information about avoidance areas.

As agreed during the 2018 ICCAT Annual Meeting, in 2019 the European Union will receive, in addition to the allocated quota of 17536 tonnes, an extra allocation of 87 tonnes, exclusively for artisanal vessels from specific archipelagos in Greece (Ionian Islands), Spain (Canary Islands) and Portugal (Azores and Madeira).
